Is Time Running Out?
There are 2 major issues affecting how long you can leave it before you litigate against your surveyor:
Firstly there is a six year limit in that litigation cannot be commenced six years after the 'wrong' that is claimed. There is legal precedent however that this time limit takes effect from the date at which you become aware of the 'wrong'.
Secondly the recent Jackson Report, a 1000 page report by Lord Justice Jackson has called for an end to 'no win no fee' litigation. This could mean that unless you have £20,000 of your own money to cover litigation fees you could be denied access to justice. The proposals have not yet been adopted so there is still time but if you are planning to delay litigation for any reason please be aware of this issue.
