Some people have asked us why we don't offer a "No Win No Fee" agreement to implement this product. The simple answer is that the litigation element of the service is "no win no fee", however, this is just one component of the whole service that we have put together. There are upfront preparation costs that need to be covered and this is why an element of our fee is payable in advance (see our terms and conditions).

"No win no fee" is a term that relates to the legal costs of litigation. No win no fee litigation is actually a slightly misleading term as there are always fees and costs associated with litigation. The question is whether the claimant pays those fees themselves. With No win no fee arrangements the legal costs are actually covered by an insurance policy which is provided by a very specialist company.

The product that we offer includes the "no win no fee" litigation but with these cases there is a lot more involved than the litigation alone. The litigators require substantial case files including market research, expert witness statements and retrospective valuations from R.I.C.S surveyors.

We have put in place the insurance to cover legal costs, the team of solicitors and barristers, expert witnesses and surveyors and formulated a precise method of preparing the case files for the litigators.
