Professional negligence is defined in the law of tort to cover situations where a 'professional' person is deemed to have fallen short in the quality of the services that they provide. The defendant will be a person who represents themselves as having above average skills in a particular field and the claimant will have to demonstrate that the duty of care owed by the defendant to the claimant fell short of what would be expected of a reasonable person.

Where professional negligence has occurred and can be proven the claimant has the basis of an argumentĀ for compensation.
